These Terms and Conditions of Sale (“T&Cs”) apply to all sales concluded between:

(hereinafter referred to as “Filtre-Outlet”, “we”, “us” or “our”)

and any individual or legal entity purchasing products through the Filtre-Outlet.fr website (hereinafter referred to as the “Customer”).

By placing an order on the Website, the Customer fully and unconditionally accepts these T&Cs.

 

Article 1 – Scope of Application

These T&Cs exclusively govern the sale of products made through the Website.

They take precedence over any other document unless expressly agreed otherwise in writing by Filtre-Outlet.

 

Article 2 – Customer Eligibility

The Customer confirms that they are at least 18 years old and have the legal capacity required to enter into a contract.

Where the Customer acts on behalf of a company or other legal entity, they confirm that they have the necessary authority to bind that entity.

 

Article 3 – Products

The essential characteristics of each product are described on the relevant product pages of the Website.

Product photographs, illustrations and images are provided for information purposes only and do not form part of the contractual agreement.

Customers are advised to carefully review the product description before placing an order.

 

Article 4 – Prices

Prices are displayed in euros (€) and include all applicable taxes (VAT), unless stated otherwise.

Delivery charges are displayed before the order is finally confirmed.

For deliveries outside the European Union, customs duties, local taxes or import charges may be imposed by the authorities of the destination country. These costs remain the sole responsibility of the Customer.

Filtre-Outlet reserves the right to change prices at any time. Products will be charged according to the price displayed at the time the order is confirmed.

In the event of an obvious pricing error caused by a technical malfunction or a clear administrative mistake, Filtre-Outlet reserves the right to cancel the affected order after informing the Customer.

 

Article 5 – Ordering

Orders are placed exclusively online through the Website.

The Customer is responsible for ensuring that all information provided during the ordering process is accurate, including delivery address and email address.

Before final confirmation, the Customer may review the order details and correct any errors.

The order becomes legally binding once payment has been successfully confirmed.

An order confirmation email will be sent to the email address provided by the Customer.

Filtre-Outlet reserves the right to refuse or cancel an order in the event of:

  • payment failure;
  • fraud or attempted fraud;
  • an existing dispute with the Customer;
  • clearly incorrect information being provided.

 

Article 6 – Payment

Payment is due immediately when the order is placed.

The Website accepts payment methods offered by its secure payment providers, including PayPal and compatible bank cards.

Payments are processed using secure encryption protocols that comply with industry standards.

Filtre-Outlet does not have access to the Customer’s complete payment card details.

 

Article 7 – Product Availability

Product offers remain valid while they are displayed on the Website and subject to availability.

If a product becomes unavailable after an order has been confirmed, the Customer will be informed as soon as possible and may choose to:

  • receive a full refund;
  • receive an equivalent replacement product subject to agreement;
  • wait until the product becomes available again.

 

Article 8 – Delivery

Products are delivered to the address provided by the Customer when placing the order.

Delivery times are provided as estimates.

In accordance with Article L216-1 of the French Consumer Code, Filtre-Outlet will deliver the goods on the date or within the timeframe communicated to the Customer.

If delivery is delayed due to Filtre-Outlet, the Customer benefits from the rights provided under Articles L216-1 and following of the French Consumer Code.

Risk transfers to the Customer once the Customer, or a third party designated by the Customer, physically takes possession of the product.

Filtre-Outlet shall not be liable for delays caused by carriers or events beyond its reasonable control.

 

Article 9 – Right of Withdrawal

In accordance with Articles L221-18 and following of the French Consumer Code, consumers have fourteen (14) days from receipt of the product to exercise their right of withdrawal without giving any reason.

To exercise this right, the Customer must notify Filtre-Outlet of their decision through an unambiguous written statement sent to customer service.

Products must be returned:

  • complete;
  • in their original condition;
  • with any accessories supplied;
  • in packaging suitable for resale.

Return shipping costs remain the responsibility of the Customer unless otherwise required by law.

Refunds will be issued no later than fourteen (14) days after Filtre-Outlet receives the returned products or receives proof that the products have been shipped.

Refunds will be made using the same payment method used for the original purchase unless otherwise agreed with the Customer.

 

Article 10 – Legal Guarantees

Consumers benefit from:

  • the legal guarantee of conformity provided under Articles L217-3 and following of the French Consumer Code;
  • the legal guarantee against hidden defects provided under Articles 1641 and following of the French Civil Code.

When acting under the legal guarantee of conformity, consumers:

  • have two years from delivery of the product to take action;
  • may request repair or replacement of the product under the conditions provided by law;
  • benefit from the legal presumption of non-conformity during the applicable statutory period.

Consumers may also rely on the legal guarantee against hidden defects in accordance with the French Civil Code.

 

Article 11 – Defective Products and Liability

Filtre-Outlet acts as a distributor of products.

All manufacturer instructions, technical recommendations and installation guidelines must be followed.

The Customer remains responsible for selecting a product suitable for their requirements and intended installation.

Filtre-Outlet’s liability is limited to foreseeable direct losses resulting from a contractual breach.

Nothing in these T&Cs limits the statutory rights of consumers relating to legal guarantees or liability for defective products.

 

Article 12 – Force Majeure

Filtre-Outlet shall not be liable for any failure or delay in performing its obligations where such failure results from a force majeure event as defined under Article 1218 of the French Civil Code.

 

Article 13 – Personal Data

Personal data collected through the Website is processed in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).

Details regarding data collection, use, storage and individual rights are provided in the Website’s Privacy Policy.

 

Article 14 – Intellectual Property

All elements appearing on the Website, including texts, logos, photographs, illustrations, graphics, videos, databases and software, are protected by intellectual property laws.

Any unauthorised reproduction, distribution or use is prohibited.

 

Article 15 – Consumer Mediation

In accordance with Articles L611-1 and following of the French Consumer Code, consumers have the right to use a consumer mediation service free of charge in order to seek an amicable resolution of a dispute.

The contact details of the relevant consumer mediator will be provided on the Website in accordance with applicable regulations.

Consumers residing in the European Union may also consult the European online dispute resolution platform where applicable.

 

Article 16 – Applicable Law and Jurisdiction

These T&Cs are governed by French law.

In the event of a dispute, the parties will first attempt to reach an amicable resolution.

If no agreement can be reached, jurisdiction will be determined in accordance with applicable legal rules.

 

Article 17 – Changes to These T&Cs

Filtre-Outlet reserves the right to amend these T&Cs at any time.

The applicable T&Cs are those in force on the date the Customer places their order.
